The Fair Employment and Housing Act (FEHA) requires California employers to take reasonable steps to prevent and correct workplace discrimination and harassment. On May 2, 2017, the California Department of Fair Employment and Housing (DFEH) released a “Workplace Harassment Guide for California Employers,” providing recommended practices for preventing and addressing workplace harassment.
The nine-page publication provides employers with suggestions on how to develop an effective anti-harassment program, how management must respond to reports of harassment, how to conduct an investigation, and how to eliminate unlawful behavior.
The DFEH also made a new poster and brochure on sexual harassment available. Employers are not required to use either, but doing so satisfies an employer’s obligation under Section 12950(b) of the California Government Code to provide employees an information sheet regarding sexual harassment.
